1. Acceptance of terms
By creating an account, hiring a microservice or otherwise using the services offered by TARELLO TECNOLOGIA LTDA. (Brazilian company ID 33.431.385/0001-09), hereinafter "Tarello", you agree to these Terms of Use. If you don't agree, don't use the services.
2. Definitions
- Service: the Tarello platform, accessible at tarello.io and console.tarello.io, including all backend microservices.
- Customer: individual or legal entity holding an active Tarello account.
- Project: isolated container that groups microservices hired by the Customer.
- Customer Content: any data stored or processed by the microservices on behalf of the Customer.
3. Account registration
The Customer is responsible for:
- Providing accurate, complete and up-to-date data when signing up;
- Keeping confidential the credentials and API keys generated in the Console;
- Notifying Tarello immediately of any unauthorized use of the account.
Tarello may refuse, suspend or terminate accounts that violate these Terms.
4. Acceptable use
It is prohibited to use the Service for:
- Illegal activities under Brazilian law or the law applicable to the Customer;
- Hosting or distributing malware, phishing, content that infringes copyrights or material that exploits minors;
- Sending spam or unsolicited bulk communications;
- Attempting to compromise the security of the infrastructure or of other Customers;
- Operating services that violate data protection laws applicable to the Customer's end users.
5. Billing and payment
Plans and prices are presented at tarello.io/pricing. Billing occurs monthly, per microservice hired, according to the selected plan. The first 14 days after the first activated microservice are free. After the trial period, charges are made via the registered payment method.
Overage of the monthly request limit is charged at R$ 10.00 per additional 1,000 requests, at cycle close.
Delays exceeding 5 days may result in microservice suspension. Delays exceeding 30 days may result in account closure, with data retention for an additional 30 days.
6. Intellectual property
Tarello retains all rights over the Service, brand, source code and documentation. Customer Content remains the property of the Customer; Tarello only processes it to deliver the Service.
7. Availability
Tarello maintains a specific SLA, available at /legal/sla. The Customer acknowledges that no service has 100% availability, and that scheduled maintenance may occur with reasonable advance notice.
8. Limitation of liability
The Service is provided "as is". To the fullest extent permitted by law, Tarello is not liable for indirect damages, lost profits or data loss arising from the use or impossibility of use of the Service. Tarello's total liability in any case shall not exceed the amount paid by the Customer in the 12 months prior to the event that gave rise to the claim.
9. Modifications
Tarello may update these Terms at any time. Material changes will be communicated by email and in the Console at least 30 days in advance. Continued use after the effective date constitutes acceptance.
10. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil. The forum of São José do Rio Preto, SP, is elected to resolve any disputes.
